1. Agreement to these terms

These Terms of Service are a binding agreement between you and Blue Aria Innovations, LLC, doing business as JobRamen (“JobRamen,” “we,” “us,” or “our”). By accessing our website, creating an account, signing an order, or using our services, you agree to these terms and our Privacy Policy. If you use JobRamen for a company, you confirm that you have authority to bind that company.

2. Our services

JobRamen provides customer communication, call answering, lead qualification, scheduling, dispatch support, customer relationship management, marketing automation, review management, reporting, websites, funnels, and related services. Specific features, usage limits, setup requirements, and pricing may be stated in your order form or service agreement. If that agreement conflicts with these terms, the signed agreement controls.

Automated tools, including artificial intelligence, can make mistakes. You remain responsible for reviewing important information, maintaining accurate business details, and making decisions involving safety, emergencies, pricing, employment, legal duties, or professional judgment. JobRamen is not an emergency service.

3. Eligibility and accounts

You must be at least 18 years old and able to enter a binding contract. You must provide accurate information, protect your login credentials, and promptly notify us of suspected unauthorized access. You are responsible for activity under your account and for your employees, contractors, and authorized users.

4. Customer responsibilities and acceptable use

You agree to:

• Use the services only for lawful business purposes.
• Obtain all required permissions and consents before providing personal data to us.
• Follow telemarketing, privacy, call-recording, email, and messaging laws.
• Keep customer-facing statements, calendars, pricing, and routing instructions accurate.
• Avoid unlawful, deceptive, harassing, infringing, harmful, or abusive activity.
• Not interfere with, reverse engineer, or gain unauthorized access to the services.

We may investigate suspected misuse and suspend access when reasonably necessary to protect customers, recipients, JobRamen, or the public.

5. Fees, billing, and cancellation

You agree to pay the fees, taxes, and usage charges described in your order. Recurring services renew and are billed on the schedule shown in your order unless canceled under that order. Unless required by law or stated otherwise in writing, fees already paid are non-refundable. We may change future pricing with reasonable notice. Past-due amounts may result in service suspension or termination.

6. SMS and text messaging terms

When you provide a mobile number and opt in, you agree to receive recurring automated SMS and MMS messages from JobRamen. Messages may include appointment confirmations, reminders, service updates, account notices, follow-ups, promotions, and marketing offers. Consent to marketing messages is not a condition of purchase. Message frequency varies. Message and data rates may apply.

Reply STOP to any message to opt out. You may receive one final message confirming your opt-out. Reply HELP for help, email us at Liz@jobramen.com, or call 727-870-4218. Carriers are not liable for delayed or undelivered messages. You must be the subscriber or customary user of the mobile number you provide and notify us if that number changes.

Mobile opt-in information and consent will not be shared with third parties or affiliates for their marketing or promotional purposes. We may share data with service providers that help deliver messages, subject to confidentiality and use restrictions. See our Privacy Policy for more information.

7. Intellectual property

JobRamen and its licensors own the services, software, branding, templates, and related materials. Subject to payment and these terms, we grant you a limited, non-exclusive, non-transferable right to use the services for your internal business purposes. You retain ownership of content you provide and grant us permission to host, process, transmit, and display it as needed to provide and improve the services.

8. Third-party services

The services may connect with telecommunications carriers, calendars, advertising platforms, payment providers, and other third-party services. Their terms and privacy practices apply to their products. We are not responsible for third-party outages, changes, or acts beyond our reasonable control.

9. Disclaimers

To the fullest extent permitted by law, the services are provided “as is” and “as available.” We disclaim implied warranties, including merchantability, fitness for a particular purpose, title, and non-infringement. We do not guarantee uninterrupted or error-free operation, specific revenue, lead volume, bookings, rankings, or business results.

10. Limitation of liability

To the fullest extent permitted by law, JobRamen and its officers, employees, contractors, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, or business opportunities. Our total liability relating to the services will not exceed the fees you paid to JobRamen for the affected services during the three months before the event giving rise to the claim. Some jurisdictions do not allow certain limits, so these limits may not apply to you.

11. Indemnification

You agree to defend, indemnify, and hold JobRamen harmless from claims, losses, and costs, including reasonable legal fees, arising from your content, your use of the services, your violation of law or these terms, or communications sent at your direction.

12. Suspension and termination

Either party may end services as allowed by the applicable order. We may suspend or end access for nonpayment, unlawful activity, security risk, material breach, or harm to the service or others. Sections intended by their nature to survive termination will remain in effect.

13. Governing law

These terms are governed by the laws of the State of Florida, without regard to conflict of law principles. Any dispute not resolved informally will be brought in the state or federal courts located in Pinellas County, Florida, and each party consents to that venue and jurisdiction.

14. Changes to these terms

We may update these terms from time to time. We will post the revised version and change the effective date. Material changes may also be communicated through the services or by email. Continued use after the updated terms take effect constitutes acceptance.
